Funky Monkey Bars "Golden Rung Giveaway" - Official Rules and Terms & Conditions

1. Promotion Overview
   The Funky Monkey Bars "Golden Rung Giveaway" is a promotional event where five (5) Golden Rungs will be randomly placed inside the rung boxes of Funky Monkey Bars orders dispatched before Christmas. Customers who discover a Golden Rung will be eligible for a full refund of their qualifying purchase.

1. Eligibility
   The giveaway is open to customers who purchase a Funky Monkey Bars set during the promotional period and are legal residents of Australia. Entrants must be at least 18 years old as of the date of their purchase. Employees of Funky Monkey Bars, its subsidiaries, affiliates, suppliers, partners, and immediate family members or those living in the same household of employees are ineligible to participate. This giveaway is subject to Australian laws and void where prohibited.

2. Sponsorship
   The sponsor of the "Golden Rung Giveaway" is Funky Monkey Bars, located at 8 Stack Street, Fremantle, Western Australia 6160. The Sponsor will conduct the promotion as outlined in these Official Rules.

3. Promotional Period
   The Golden Rungs will be included in orders placed and dispatched between 15th August 2024 and 15th December 2024. All eligible orders must be placed before 11:59 PM AWST on 15/12/2024.

4. How It Works

   • Five (5) Golden Rungs will be randomly inserted into the rung boxes of Funky Monkey Bars sets during the promotional period.
   • Customers who find a Golden Rung in their order must contact Funky Monkey Bars at info@funkymonkeybars.com or 1300 912 198 and provide photographic proof of the Golden Rung and their order details to claim the prize.

1. Refund Conditions

   • The refund will cover the total purchase amount of the order containing the Golden Rung, including product cost, taxes, and shipping fees.
   • Refunds will be processed within 14 business days after the receipt of valid proof.
   • Only the original purchaser is eligible to claim the refund, which will be issued to the original payment method used during purchase. Claims must be made by 10th January 2025.

1. Agreement to Rules
   By participating in the "Golden Rung Giveaway," entrants agree to abide by these Official Rules, which are binding in all respects. Funky Monkey Bars reserves the right to modify, cancel, or suspend the promotion at any time and may request additional proof of purchase or identification to verify any claim.

2. Selection and Notification of Winners
   Winners will be those who find a Golden Rung in their set. It is the sole responsibility of the customer to notify Funky Monkey Bars upon discovering the Golden Rung. The customer must provide photographic evidence of the Golden Rung along with their order confirmation details. Upon receipt of such notification, Funky Monkey Bars will verify the claim by cross-referencing the submitted proof with internal records. The company is not responsible for failure to contact the winners due to incorrect contact information or security settings that prevent the receipt of notifications.

3. Disputes
   Any disputes that arise from this promotion shall be governed by the laws of Western Australia, without regard to conflict of law principles. As a condition of participating in this promotion, entrants agree that any disputes that cannot be resolved between the entrant and Funky Monkey Bars shall be exclusively resolved individually, without resorting to any form of class action, in a court located in Western Australia with proper jurisdiction.

4. Limitation of Liability
   By participating, entrants release Funky Monkey Bars and its affiliates from any and all liability arising from participation in the promotion, including but not limited to:

• Errors in the administration of the promotion.
• Technical or human errors that may occur during the entry or selection process.
• Loss, damage, or delays in claims due to postal or communication issues.

Participants agree that Funky Monkey Bars shall not be held liable for any such occurrences, and participation is entirely at the entrant's own risk.

11. General Conditions
    Funky Monkey Bars reserves the right to modify the promotion, including the rules and conditions, at any time without prior notice. The company is not liable for any fraud, technical errors, or unauthorized human intervention that affects the integrity of the promotion.

    Information submitted in connection with the Golden Rung Giveaway is subject to Funky Monkey Bars' Privacy Policy. 13. Winners List
    To obtain the names of the winners or a copy of these Official Rules, please send your request by mail to: Funky Monkey Bars, 8 Stack Street, Fremantle, WA, 6160, Australia. Requests must be postmarked no later than 15th January 2025.

14. Rights Granted by You
    By participating in the Golden Rung Giveaway and placing an order with Funky Monkey Bars, you acknowledge and agree that Funky Monkey Bars, its agents, representatives, licensees, successors, and assigns shall have the right to use your name, likeness, image, statements, and any other biographical information in connection with the promotion for advertising, publicity, promotional materials, and public relations, worldwide and in perpetuity, without further consent or compensation.

15. Terms & Conditions
    Funky Monkey Bars reserves the right to modify, suspend, cancel, or terminate the Golden Rung Giveaway in the event of unauthorized human intervention, technical issues (such as a bug or virus), fraud, or any other cause beyond its control that affects the security, fairness, or proper conduct of the promotion. Any individual who tampers with or attempts to tamper with the operation of the Golden Rung Giveaway or otherwise violates these Terms & Conditions may be disqualified at the sole discretion of Funky Monkey Bars.

16. Social Media Channel-Specific Rules
    The Golden Rung Giveaway hosted by Funky Monkey Bars is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or any other social media platform. By participating in the giveaway, you acknowledge that these platforms are not responsible for any aspect of the promotion.
